SPITTIN FIRE: R.A. JACKSON SUGGEST WE BEGIN THE JURY NULLIFICATION BOYCOTT NOW.
JURY NULLIFICATION MEANS:
Jury nullification occurs when a jury returns a verdict of "Not Guilty" despite its belief that the defendant is guilty of the violation charged. The jury in effect nullifies a law that it believes is either immoral or wrongly applied to the defendant whose fate that are charged with deciding.
Advocates of jury nullification argue that jurors have both the power and the right to acquit a guilty defendant if they believe the law or its application is unjust. According to a recent ruling by a federal appeals court, they are half right.
Can jurors be punished?
Jurors cannot be punished for reaching a "wrong" decision (such as acquitting a defendant despite their guilt being proven beyond a reasonable doubt). A defendant who is acquitted cannot be tried again for the same alleged crime in front of another jury.
